Terms of Service

These terms govern your use of Passenger Index (passengerindex.com and its data, pages, downloads and emails, together the "Service"), operated by Passenger Index LLC ("we", "us"). By using the Service or subscribing, you agree to these terms, our Privacy Policy and our Data Disclaimer. If you do not agree, do not use the Service.

1. The Service

Passenger Index publishes US air-travel statistics compiled from US government sources: TSA checkpoint throughput and CBP international arrivals. Some of it is free. Paid and Premium plans add more history, more frequent figures, year-over-year changes and downloads, as described on the site. We may add, change or remove features, data series or plan contents at any time.

2. Accounts

Each subscription, and each Premium Enterprise seat, is for one named person. You sign in with your email and your password, or with Google. Keep your password confidential and do not share your account; an account can be signed in on up to two devices at a time. You are responsible for activity under your account. If you think your password has been exposed, change it with "Forgot your password?" or tell us at contact@passengerindex.com. You must be at least 18 to subscribe.

4. What you may do with the data

The underlying TSA and CBP source data are US government works in the public domain; these terms cover our compilation, calculations, adjustments and presentation of them.

5. Acceptable use

Do not attempt to get around sign-in or plan limits, access another subscriber's account, scrape or harvest subscriber data, run automated requests that burden the Service, probe it for vulnerabilities, or use it for anything unlawful. We may suspend or end access for a breach of these terms, without refund.

6. Not investment advice

The Service is information, not advice. Nothing in it is a recommendation to buy, sell or hold any security. See the Data Disclaimer.

7. Accuracy and availability

We compile the data carefully and explain our methods on the Methodology page, but source data can be late, incomplete, revised or wrong, and our processing can contain errors. Figures may change when sources are revised or when we correct a mistake. We do not promise that the Service will be uninterrupted, timely or error-free.

8. Disclaimer of warranties

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PASSENGER INDEX LLC AND ITS MEMBERS, MANAGERS AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING OR INVESTMENT LOSSES, OR LOSS OF DATA, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US$100 IF YOU HAVE NOT PAID US.

10. Indemnity

You agree to indemnify Passenger Index LLC against claims, losses and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Service or its data.

11. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.

12. Changes and contact
